2.John Marshall argued that the United States should not have a total control of the Navajos and they should run their government and stuff.
John Marshall had three major cases that had an impact on the indians, and he was on both sides. He tried to make the Indians more independent and a little more sovereign. The Indians had to follow the United States Laws and the states had no say on what they can do with them. John Marshall had an idea of a treaty that the Indians and United States no longer fight. The U.S. gave them land, the United States had to protect them from foreign threats including from the U.S. citizens. The Indians are their own nation with limited sovereign.
John Marshall was the chief justice of the supreme courts.
Some of the important court cases include....Johnson V. Macintosh which was the conflict on inherited land being sold the people. The issue then resolved with the ruling over to Macintosh because the land was sold by congress. Cherokee V. Georgia was when the state of Georgia had conducted a relentless campaign to remove Cherokees which falls into the third court case of Worchester V. Georgia which stated that Georgia had no authority to pass a nation recognized through treaties with the United States.
In my research of the Oliphant Vs. The Suquamish Indian Tribe, I had found out that it all began with the arrest of Mark D. Oliphant on the charges of assulting and resisting arrest from a tribal officer. The plantiff claimed it was habeas corpus on the tribal court that had tried him in their court. So he took it to the surprme court and the court agreed with Mark Oliphant.
